Customer Agreement


This is the agreement between (“Customer”) and Sean Von Zwehl d/b/a/ Computer Mechanic (“Computer Mechanic”).

Customer Responsibilities:
1. An adult (18 years or older) must be present during the entire installation or repair process. If the Computer Mechanic arrives at the scheduled time and no adult is present, or if the adult leaves prior to the service being completed, the Computer Mechanic will leave and you will be subject to the stated service charges equal to $60.
2. You must type in all passwords for security purposes.
3. Computer Mechanic is not responsible for lost data. Ensure you have backed up all your important data prior to any service.
4. Customer is responsible for any data migration to a new PC or hard drive. Data transfers are available for an additional fee.
5. Customer is responsible for the removal of any packing materials or trash.
6. Technical Service fees are non refundable once the service process has begun (any cancellations must be done prior to actual service to receive any prorated refund).

Tasks that Must Be Completed Prior to Install or Repair:
1. Please back up all vital data files prior to service being performed. Computer Mechanic is not responsible for lost data.
2. Any hardware devices, components, peripherals, software or cabling needed for the install must be purchased/supplied by you.
3. If network connectivity is desired for multiple devices, you must supply device (router, hub) with adequate number of ports to support the required number of devices.
4. ISP/Internet or home network connection must be activated and working properly prior to any related install.
5. All equipment being installed must be located in the general area where the install is taking place.
6. The Computer Mechanic must be given immediate access to the equipment so the service call can begin as scheduled.
7. Customer must provide adequate environment (power, space, etc.) for the scheduled service.
8. Consumer is responsible for providing power cords and surge protectors.
9. Customer must have available all legally licensed software and media that may be required.

Scheduling: Standard service hours are Mon. – Fri. 9 A.M. to 7 P.M., Sat. 10 A.M. to 5 P.M. Additional charges may apply for rapid response or service outside of standard hours.

Service Area: If a location lies beyond the Computer Mechanic standard Service Area, additional travel charges may apply. To determine if your location is within a Computer Mechanic standard Service Area call 516-697-2381 for information and applicable travel charges.
Service Warranty: Computer Mechanic warranties his workmanship for a period of 30 days from the service date. This includes issues with the configured installation set up by the Computer Mechanic. Computer Mechanic is not responsible for issues due to setting changes, new software upgrades, ISP connection issues, relocation, viruses or spyware issues or misuse. Additional trips not covered by the warranty will be subject to charges. Tutorial services not included w/ warranty. Computer Mechanic warranty is only valid on virus, spyware, and adware removal service if the Computer Mechanic verifies proper protection against such threats. Computer Mechanic’s sole responsibility for any breach of this warranty shall be re-perform such service, and in no case shall Computer Mechanic be liable for payment money damages other than reimbursement of applicable fees in the event Computer Mechanic is unable to resolve any problems.

Service Limitations: Computer Mechanic reserves the right to refrain from providing any or all services ordered and refund the customer's payment, wholly or in part, if minimum system requirements are not met or if technical conditions (such as wiring difficulties or physical barriers) or customer requirements are unusual, extensive, or beyond the scope of this service agreement as reasonably determined by the Computer Mechanic.
Force Majeure: If the Computer Mechanic’s ability to render services is impaired by circumstances beyond the control of Computer Mechanic, Computer Mechanic may choose not to provide services or cease providing services at the time such circumstances should arise.

Release of Liability: You agree to release and hold harmless Computer Mechanic from and against any loss, liability, or damage that you, the owner, or lessee may suffer. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals as a result of Computer Mechanic's service. If Computer Mechanic is unable to resolve any issue and issues from breach of the service warranty, customer shall be limited to a refund of all or a portion of the applicable fees, which shall constitute liquidated damages and are a reasonable estimate of damages to you.

CHANGES, CANCELLATIONS AND REFUNDS:

To change or cancel your order: You must contact the Computer Mechanic at 516-697-2381 or email ComputerMechanic@GetFixedFast.com at least 2 hrs. prior to your scheduled appointment. If you are not satisfied with your Computer Mechanic service: Call 516-697-2381 for resolution. If there is a problem with the service Computer Mechanic provided and you notify us within the allotted time period, we will work to remedy the problem quickly and at no additional cost.
